Who is responsible for waterproofing in my condo bathroom?

Answer

The Act lists the waterproof membrane attached to an external wall or roof as common property, and treats structural slabs as common property but not the underlayment or flooring finishes. Wet-area finishes inside a unit are therefore usually the owner's to maintain, and prescribed by-law 15 requires owners to keep sanitary fittings and pipes in good condition. If water damages the unit below, the Strata Titles Board presumes the defect lies in the unit above unless proven otherwise.

The fuller picture

Condo renovations need MCST approval under the development's by-laws, and MCST authorisation under section 37 of the Building (Strata Management) Act for anything that affects the building's appearance or structure. Works adding floor area need a 90% resolution and URA permission. Structural works need a PE and BCA approval; household shelters, façades and balconies are tightly restricted.
